Agreement is made upon purchase.

THIS APPLIES TO THE HOMING OF A PUPPY ONLY FOR FAMILY OR COMPANIONSHIP PETS, NOT FOR USE IN RESEARCH FACILITIES SOCIALLY HOUSED OR OTHERWISE, COMMERCIAL KENNELS, MILLS, COMMERCIAL BREEDING AUCTIONS, RESCUES, OR SPORTING RINGS. 

 

We provide Vet paperwork of 1st vaccines and de-worming, register the puppy to you, plus offer life long support if you require it at any time and you promise not to re-sell the puppy/dog and to neuter/spay him or her. This is standard for most purebred registries.  PLEASE READ THIS OVER AND IF THERE IS ANYTHING YOU WANT TO DISCUSS PLEASE DO NOT HESITATE TO ASK. You can print this form for your copy.  Email confirmation of purchase is a valid form of agreement.

A purebred registration ensures that registrations stay intact, that dogs don't end up in shelters, rescues or mills and is a commitment to responsible ownership. As long as you don't plan on re-selling or breeding your pet there should be no worries.

 

Part of this information is pertinent specifically to commercial breeders/auctions, puppy mills and research facilities which are not acceptable and puppies are not available to.

This puppy is being purchased as a Companionship or Family Pet.

A deposit was made by email transfe. The bank transfer record contains receipt. Final full payment made by email transfer (preferred), or by cash will have a physical receipt given. Balance is due to Seller before this dog is placed in the Buyer’s possession on the date of pick up or prior to. (We do not accept credit card or cheques.) Payment installment arrangements can be made individually.

 

This puppy does not leave the Seller's premises without payment in full. This puppy was carefully selected and chosen by reservation (by photos, videos, or in person) and deposit, not first come first serve.  Deposit may be placed toward a future litter if buyer needs an alternate date. The Buyer understands that once a deposit is made it is a commitment to buy said dog and is therefore NON-REFUNDABLE BUT IS TRANSFERABLE to a puppy in a future litter if desired. Deposits are transferable for 5 years.

It is agreed by both parties, the following:

The puppy purchased as a PET and the new owner will not breed this pet. If you are interested in breeding please let us know because there would be a contract for that. Your puppy is intended for pet only and sold for companionship or family pet purpose. The pet will be neutered or spayed by a year old. Seller certifies  that the puppy is in good health to the best of Seller's knowledge and is free of congenital disorders and deformity. You will not re-sell or re-home this pet but can return at any time if necessary for refund as stipulated below.

SELLER'S RESPONSIBILITY

​

The above referenced dog/puppy is being sold to the buyer(s) in good health with first set of vaccinations and de-worming. Vaccinations, 1st set, include: Distemper, Hepatitis (CAV2), Parainfluenza, Parvovirus.

Buyer agrees to having next sets of vaccines done.

​

*If BUYER chooses to get first set of vaccinations done at a veterinarian of their choice that option is available and SELLER certifies that said puppy is in good health to the best of Seller's knowledge and has displayed no signs of illness.

If in the rare instance that a Vet appointment is not available (due to covid backlogs for example), then the amount of the first vaccines is deducted off the total price of the puppy.

​

We will follow-up with the new owner after the first day and first week and on occasion during the first year after re-homing to ensure puppy is transitioning well.

​

Registration of puppies is for compnaionship registered purebreds.

HEALTH GUARANTEE and INFORMATION

​

• This puppy is free of defects and congenital disorders and in perfect health to the absolute best of our knowledge. Puppies are checked by Veterinarian prior to homing unless Buyer states they choose to do so. Puppies are Vet checked for gait, reflexes, eyes, ears, heart and lungs and Vet folder is provided. 

​

• A puppy can be returned at any time for any reason and refund determined by length of time in the new owner's care. Refund would be given at the time the puppy is re-homed. Puppy can also be exchanged for a new puppy upon valid reason for return.

​​

• Do NOT give this puppy or as an adult dog Lepto vaccine. It is known to cause a severe reaction even death in any small or toy breed dogs. It is not a required core vaccine. Lepto vaccine is intended for large dogs in areas with open water that might contain other bacteria, not suited for small toy breeds.

​​

• The adult dogs and their puppies are top quality Havanese companionship or family pets. Show dog stipulations do not apply in the handling or consideration of these pets. For example, If puppy grows to be 15 lbs or is an inch taller than standard s/he might not be allowed in a Dog show event but that doesn't make the dog less quality or less of a Havanese. If in the future we have Show Dogs a different contract will be applied.

• Seller does not guarantee against conditions brought on by stress or environmental changes that we cannot control for once the puppy leaves our care; therefore this does not cover any illnesses once the puppy leaves premises (example: contagious illness, viral or bacteria, illness by fleas or acquired infection, stress or illness acquired by contact with other dogs such as in temporary care/doggie day-care, grooming facilities or free run parks; or wounds as a result of mishandling, etc.) For example, if soon after homing if Buyer takes the puppy to a free run dog park or a grooming facility and he or she gets injured or acquires a virus that is something we have no control over and not responsible for.

• We are able to cover the 1st set of Vaccines and de-worming and Buyer is responsible for additional vaccines. This is complimentary not obligatory. Buyer may choose to get first set of vaccines at a veterinarian of their choice in their area but we prefer to before homing. If puppy has a "belly button" or umbilical hernia which occurs when the mother pulls on the umbilical cord at birth this is NOT a health condition or flaw, does not affect the behavior, stamina or agility of the puppy, it simply appears as an "outty," and can be easily changed at the time puppy is neutered or spayed for approximately 50 dollars, which is optional. These are common in both purebreds and mixed breeds. They can also go away on their own by a few months of age.

• Parent Dogs - are in good health with no defects and​​ mature age.

​

• Size and Coat - Seller is knowledgeable to suggest closest approximations according to the breed standard and according to past and current litters. LONG HAIRED can have either silk coat or thick under-coat, hypo-allergenic, low-shedding and long-haired can be determined by 10 weeks old. SHORT-HAIRED are smooth coats, low-shedding, not hypoallergenic. It takes up to two years for normal hair growth for either long or short haired therefore exact fur length for short-haired varies. In most cases by 10 wks old a short-haired or smooth-coat is determined. We do not guarantee hair length, we do have Satins in the line and they are as much purebred as the long-haired. They display the same characteristics and temperament and the only difference would be the if Buyer has allergies. Short/smooth-coat hair length will vary to short all over, to having crests, wisps on haunches, with plumed tail.​ Long-haired fully grown, fur will be long, approx 2 inches from the ground with plumed tail. Havanese typically grow from 8 - 11 inches tall and approximately 11 inches in length and will weigh from 7 - 14 pounds.

• Allergies - This only applies to Shorthaired/Shavanese. It is the responsibility of the Buyer to be aware of such a possibility as allergies and such consideration prior to purchase. If after adoption, any person suffers from allergies attributed to the new puppy Seller has no obligation to reimburse Buyer. It is under Seller's discretion what action can be taken at that time and Buyer will not re-home or re-sell the puppy themselves. Buyer can choose a puppy with alternate fur from a future litter in exchange if desired and return the puppy they chose to us. Note that per breed standard Havanese are typically known to be hypo-allergenic and low-shedding; there is discrepancy with short-haired who are not hypo-allergenic due to not having an undercoat.

THE RESPONSIBILITIES OF THE BUYER

 

• The puppy should be neutered/spayed by 12 months and/or promise not to breed because we are homing for family pets. A breeding contract is available by request. 

​

• If this puppy is found to be neglected or harmed, the buyer will surrender said puppy to Seller unconditionally.​

​

• This puppy /dog will never be used for the purpose of fighting or any other sport detrimental to the breed and its reputation.

​​

• Notification will be given before transfer of ownership of this dog. If at any time the Buyer decides to sell or give away the Seller will regain ownership of the puppy/dog for re-homing and/or approve new applicant. 

​​

• Under no circumstances is this puppy/dog to be sold, leased or given away to another person including a new owner, Breeder, Pet Store, Laboratory, Research Facility or staff who socially houses for research, private or municipal animal shelter, commercial kennel or puppy mill. Re-homing is on this seller's responsibility per this contract as the registered breeder/pet professional.

 

• Buyer agrees they are not acting as a buying agent for any such person, including a breeder, pet store or commercial kennel or research facility or puppy mill. No third party sales - for Buyers who have Assistants or professional shoppers please clearly state your role and confidentiality is respected. Under no circumstances is this puppy/dog to be kept in a breeding-kennel-commercial operation or to be used in a puppy mill or research facility.

 

• If Seller finds that Buyer may not be able to provide adequate care for the puppy/dog, (for example due to a Buyer's declining health), puppy/dog will be returned to Seller, refund determined by length of time before return and minimum of deposit refunded and the contract will be null and void.

 

• ​If due to other un-unforeseen circumstances the puppy/dog needs to be returned a minimum refund of the deposit amount will be refunded. Depending on the length of time and reconditioning and time to re-home the puppy/dog, if refund is greater than the deposit amount the amount to be refunded at the time the puppy is re-homed to a new home. Return of the puppy is the responsibility of the Buyer. The puppy/dog will not be re-sold or re-homed by the purchaser, this applies to the life of the dog. This does not apply to owners who leave their dogs in their Wills to a caring party.

• The Buyer agrees to maintain preventative care of the puppy and ensure good health through proper nutrition, proper exercise and preventing stress and injuries.

​​

• This puppy/dog will be provided with proper puppy/adult dog food, fresh water, veterinary care, proper shelter from the heat and in cold, active companionship and socialization. Ample quality time will be given to this puppy/dog. Buyer is aware that this puppy is a living being and agrees to treat as a valued family member. This puppy is sold with the understanding that it is to go to a select home to be socialized properly and become a family member.

This contract is legal and binding. If you do not understand any part please seek professional advice. Any misinformation on the application or violations of this agreement will constitute legal action toward the Buyer. We home puppies on a trust basis and with every effort to protect a happy transaction and maintain reputation(s).
 

Pet Professional reserves the right to approve the sale and/or refuse or cancel the sale of a puppy at any time with any reason even after the sale. In this case the deposit will be refunded in full immediately. Full refund given at the time the puppy is re-homed to a new home if buyer returns within 3 months and after that time frame a partial refund determined by length of time.

Seller is available for life-long support, consult or advice for the life of the puppy/dog.

This agreement is understood and valid once purchase is made.  Email confirmation of purchase is a valid form of agreement.
